Double opt-in, where a subscriber requests an newsletter and then is sent an email asking to confirm the subscription is thought of as one of the best approaches. Yet in Germany someone tried to show that double opt-in breached German law. Fortunately the court ruled that double opt-in did meet German legislation, but this case illustrates the high level of concern about privacy in Europe.
